Rolawn successful in Trademark action
11th August 2006
Rolawn, Britain's largest turf grower and leading topsoil supplier, has successfully concluded its legal dispute with Online Turf. The dispute concerned Online Turf's use of Rolawn's legend 'BRITAIN'S FINEST TURF', which Rolawn first devised in the 1980's and has since exclusively used as a central part of its advertising and promotional strategy. The dispute was concluded on the basis of a signed undertaking given to Rolawn by Online Turf, under the terms of which Online Turf has agreed (amongst other things) not to use 'BRITAIN'S FINEST TURF' in connection with its business at any time in the future.
"We are very satisfied with the outcome of this dispute which confirms that Rolawn is indeed 'BRITAIN'S FINEST TURF'" comments Paul Dawson, Rolawn's Managing Director. "At Rolawn, we see innovation, whether as to our new product development, our service initiatives, our channels of distribution or our marketing and promotional activities as central to our business and our position as market leader. The intellectual property we generate as a result is critical to our ongoing success and we are vigorous in protecting it, as this case demonstrates. The clear message to our competitors is that Rolawn will not hesitate to pursue all those it feels have transgressed upon its rights".
